Workshop Liability Release, Waiver & Assumption of Risk
Please Read Before Participating
By registering for or participating in a Stardust and Solder Stained Glass workshop, I acknowledge and agree to the terms of this Workshop Liability Release, Waiver & Assumption of Risk.
1. Workshop Activities
I understand that Stardust and Solder workshops may involve hands-on stained glass activities, including cutting and handling glass, grinding or shaping glass, copper foil, soldering, use of hand tools and studio equipment, application of flux and patina, cleaning and finishing glass, and other related activities. The specific activities, tools, materials, and equipment used may vary depending on the workshop.
2. Inherent Risks
I understand that stained glass work involves inherent risks of injury and property damage, including, but not limited to:
- Cuts, punctures, abrasions, and other injuries from glass or sharp materials;
- Burns from soldering irons, heated metal, molten solder, or other hot materials;
- Eye injuries from glass fragments, solder, or other materials;
- Exposure to glass dust, particles, fumes, flux, solder, patina, cleaning products, or other workshop materials;
- Injuries resulting from the use or misuse of hand tools, grinders, soldering equipment, or other studio equipment;
- Slips, trips, falls, or other accidents in or around the workshop area;
- Injuries caused by the acts or omissions of other participants;
- Damage to clothing or personal property; and
- Other risks inherent in or reasonably associated with participation in stained glass activities.
I understand that accidents and injuries may occur even when reasonable safety precautions are followed.
3. Safety Requirements
I agree to follow all safety instructions provided by Stardust and Solder, its instructors, and the host facility. I agree to:
- Use tools and equipment only as instructed;
- Wear safety glasses and other protective equipment when required;
- Wear appropriate clothing and footwear for stained glass work;
- Secure long hair and avoid loose clothing around hot tools;
- Handle glass, tools, solder, chemicals, and other materials responsibly;
- Keep my workspace reasonably clean and safe;
- Immediately report injuries, unsafe conditions, broken equipment, or other safety concerns to the instructor; and
- Follow all posted rules and reasonable instructions provided during the workshop.
I understand that Stardust and Solder may require me to stop participating in an activity or leave the workshop if, in the instructor's reasonable judgment, my conduct creates an unsafe situation for myself or others.
4. Assumption of Risk
I voluntarily choose to participate in the workshop with knowledge of the risks described in this agreement. I knowingly and voluntarily assume the risks inherent in participating in stained glass activities, including risks that cannot reasonably be eliminated without changing the nature of the activity. I understand that I am responsible for deciding whether I am physically and otherwise able to participate safely.
5. Release and Waiver of Liability
To the fullest extent permitted by Minnesota law, I release and waive claims against Stardust and Solder Stained Glass, its owners, instructors, employees, agents, representatives, and the host facility and its applicable personnel (collectively, the “Released Parties”) for bodily injury, death, or property damage arising from my participation in the workshop, including claims based on the ordinary negligence of a Released Party, except to the extent such liability cannot legally be waived or released.
Nothing in this agreement is intended to release or waive liability that Minnesota law does not permit to be released or waived, including liability for conduct constituting greater than ordinary negligence or intentional misconduct.
6. Indemnification
To the fullest extent permitted by law, I agree to be responsible for claims, losses, damages, or expenses arising from my own negligent or wrongful conduct during the workshop, including claims brought by another person as a result of my conduct. This provision does not require me to indemnify or hold harmless a Released Party to the extent prohibited by Minnesota law.
7. Personal Property
I understand that I am responsible for my personal belongings. To the fullest extent permitted by law, Stardust and Solder is not responsible for lost, stolen, or damaged personal property brought to or left at the workshop.
8. Medical Emergencies
If I am injured or experience a medical emergency during a workshop, I authorize Stardust and Solder, its instructors, or the host facility to obtain reasonable emergency assistance on my behalf if I am unable to do so myself. I understand that I am responsible for my own medical expenses and that Stardust and Solder does not provide medical care or medical advice.
9. Participant Responsibilities
I agree to promptly inform the instructor of any condition, limitation, allergy, or other circumstance that I believe could affect my ability to participate safely. I understand that Stardust and Solder does not provide individualized medical assessments and that I am responsible for determining whether participation is appropriate for me.
10. Minors
If a participant is under 18 years of age, a parent or legal guardian must complete and sign any required minor participation and liability documentation before the minor participates. Stardust and Solder may establish additional age requirements or supervision requirements for individual workshops.
11. Photography and Video
Stardust and Solder may photograph or record workshops for educational, promotional, website, social media, advertising, and other business purposes.
By signing this agreement, I authorize Stardust and Solder Stained Glass, its owners, instructors, employees, agents, and representatives to photograph and/or record me during the workshop and to use my image, likeness, voice, and participation in photographs, video, and other recordings for these purposes without additional notice or compensation.
I understand that photographs and recordings may be edited, reproduced, published, displayed, distributed, and shared in print, digital, social media, website, advertising, or other promotional formats. I understand that I will not have the right to inspect or approve the final photographs, videos, or other materials before they are used and that I will not receive compensation for their use.
12. Severability
If any provision of this agreement is determined to be invalid, unenforceable, or prohibited by law, that provision shall be limited or severed to the extent necessary, and the remaining provisions shall remain in effect to the fullest extent permitted by law.
13. Entire Agreement
This agreement represents the understanding between the participant and Stardust and Solder regarding the risks and liability associated with participation in the workshop and supersedes prior oral or written representations concerning those matters, except for any separate terms or policies specifically incorporated by reference.
14. Acknowledgment and Agreement
By signing below, I acknowledge that:
- I have read this agreement in its entirety.
- I understand the risks associated with participating in a stained glass workshop.
- I have had an opportunity to ask questions about the workshop and its safety requirements.
- I agree to follow all safety rules and instructor directions.
- I am voluntarily participating in the workshop.
- I understand that this agreement contains a release and waiver of certain legal rights, including claims based on the ordinary negligence of a Released Party, to the extent permitted by Minnesota law.
- I understand and agree that photography and video recording may occur during the workshop and that Stardust and Solder may use my image, likeness, voice, and participation as described in Section 11.
